1. Operator and scope

These terms govern registration, participation and settlement of B2B auctions on Logistock.de.
2. Role of Logi Stock
Logi Stock provides the platform and acts as intermediary between the identified seller and the successful buyer. Where an offer expressly identifies Logi Stock as the seller, Logi Stock is also party to the purchase contract. Otherwise, Logi Stock neither owns nor sells the goods and does not assume the seller’s obligations.
Logi Stock may collect payment on behalf of the seller, transmit invoices and payment requests, perform checks and settle the sale. Bank details are provided only on the official invoice or payment request.
3. Registration and verification
Only approved business accounts may bid. Users must provide accurate company, contact and tax information and protect their accounts. Logi Stock may verify identity, business status, authority, VAT ID, creditworthiness, sanctions and anti-money-laundering requirements and may request security.
4. Lot description and inspection
The description, images, quantities, condition, location and specific terms of each lot apply. Seller information is reproduced in good faith but is not a warranty unless expressly confirmed in writing. Buyers must inspect the goods and documents to the extent reasonably possible. The seller warrants authority to sell and that no counterfeit or unlawfully offered goods are listed.
5. Bids and auction process
Every bid is binding, net and applies to the entire lot unless stated otherwise. Automatic maximum bids remain confidential. The visible bid rises only by the defined increment. Where maximum bids are equal, the earlier bid has priority. A late bid automatically extends the auction by the stated period. The reserve price remains confidential. A bid below reserve does not entitle the bidder to an award. The award becomes effective only upon express award notice. Logi Stock may interrupt, extend or cancel an auction due to technical errors, incorrect information, abuse, legal risk or justified seller instruction.
6. Buyer’s premium and seller commission
The successful buyer pays, in addition to the hammer price, a 10% net buyer’s premium calculated on the hammer price, plus applicable VAT.
The seller pays Logi Stock a 10% net seller commission calculated on the hammer price. It and applicable VAT are deducted from the seller payout. Any deviation must be clearly disclosed before bidding or agreed with the seller in writing.
7. Buyer invoice and payment
The buyer receives an invoice or payment request covering the hammer price, buyer’s premium, any transport costs and applicable VAT. The full amount must be credited to the Logi Stock account stated on the official invoice within three calendar days after auction end or invoice issuance. The buyer bears bank charges. If payment is late, Logi Stock or the seller may terminate after a reasonable grace period, resell the lot and claim proven additional costs and loss of proceeds.
8. VAT and intra-Community supplies
All bids and prices are net. VAT treatment depends on the transaction, goods location, buyer status and transport. A VAT-exempt intra-Community supply requires, among other things, a valid buyer VAT ID and timely, compliant evidence that the goods moved to another EU Member State. Statutory VAT may be charged or retained as security until verification is complete. Service fees may be treated differently, including under reverse charge. The final invoice prevails.
9. Handover, transport and risk
Goods are released only after full payment and express release. Unless stated otherwise, the buyer arranges and pays for collection, packaging, loading, transport, insurance, customs and permits. Where EXW is stated, the Incoterms edition identified in the offer also applies. Transfer of risk and title follows the purchase contract; title does not pass before full payment.
10. Seller payout
After full buyer payment, documented delivery or confirmed receipt and completion of the required identity, tax and settlement checks, Logi Stock settles with the seller. The payout generally equals the hammer price less the 10% seller commission, applicable VAT, agreed additional costs, chargebacks and other due claims. Payment is normally made within ten calendar days after confirmed receipt by the buyer. It may be withheld while a substantiated complaint, missing evidence, official review, payment recall or legal block is resolved.
11. Defects, complaints and liability
The buyer must inspect the goods immediately after receipt and promptly report visible discrepancies with photographs, delivery documents and details. Statutory business inspection duties remain unaffected. Claims concerning the goods are generally against the seller.
As intermediary, Logi Stock is not liable for title, quantity, quality, fitness, conformity, hidden defects or the seller’s ability to deliver, nor for indirect loss, lost profit or technical interruption. These limitations do not apply to intent or gross negligence, injury to life, body or health, or where mandatory law imposes liability.
12. Final provisions
German law governs Logi Stock’s platform and intermediary services. Between merchants, the courts at Logi Stock’s registered office have jurisdiction to the extent permitted by law. The seller-buyer purchase contract may be subject to additional lot-specific terms. If one provision is invalid, the remaining provisions remain effective.
